Specialist Diagnostic Services P/L and Jenny Fraumano

Members may recall that Specialist Diagnostic Services P/L trading as Dorevitch Pathology took over the operations of Pathlab in 2010, and immediately made numbers of scientists redundant. In doing so the company failed to comply with the consultative provisions of the enterprise agreement in the Union’s view.

The Union has now initiated proceedings in the Federal Court seeking a declaration that the company has breached aspects of the relevant legislation in failing to consult and that the consultant was involved in the company’s breach of the Act. Penalties are being sought against both the company and the consultant in relation to the breach.
