Private Sector Enterprise Bargaining Update

St John of God Hospitals Collective Agreement

The Agreement has been voted on by members, and will now go to Fair Work Australia for approval.

Key features of the Agreement include 3.25% increase in salaries per year over a three year period. The Agreement will expire in 2015. A copy of the Agreement will be available in the member-only pages of the website as soon as it has been approved by FWA.

St John of God Pathology Negotiations are continuing.

Western Private Hospital

We have received an offer from the hospital’s representative which includes wage increases in excess of 3% per annum. We will consult with members about the offer before responding.

Cabrini

The first meeting to negotiate the renewal of the Cabrini collective was held this week. The agreement will cover dietitians, pathology scientists and respiratory scientists; Cabrini is now employing psychologists, so the Agreement will include a new classification structure for psychologists.

Epworth Negotiations for the renewal of the Epworth agreement are to commence next week.

Red Cross Blood Service Negotiations are scheduled to recommence on 4 October 2012.

Radiation Oncology Victoria/Genesis Care

Members employed as medical physicists at ROV/Genesis Care have rejected the employer’s proposal that they enter into individual contracts, rather than renegotiate the current collective agreement - as if a sensible employee would accept an individual contract rather than being under the protection of an Agreement.

We expect progress on the new Agreement to be speedy, as the only outstanding matter is the matching of rates of pay for physicists in Victoria with the rates of pay applicable in NSW and other states.

Melbourne IVF

Negotiations have recommenced, after an interim pay increase of 3.5% was agreed, operative from 1 January 2012.

 
Paid Parental Leave and Dad and Partner Pay

Unions win paid parental leave for all working families.

Australian unions first won working mothers a right to 12 months unpaid maternity leave in 1979. After more than 30 years of campaigning, working parents will now get 18 weeks Paid Parental Leave (PPL) and 2 weeks Dad and Partner Pay (DaPP). more

 
ROUND 3 OF FWA CONTESTS GOES TO THE MSAV

FWA has determined that industrial action at Austin Health can resume.

In a comprehensive written decision Fair Work Australia (FWA) has rejected Austin Health’s application for an order to suspend industrial action.

FWA rejected AH’s arguments that industrial action taken by Medical Physicists threatened to endanger the health or welfare of patients and that therefore an order to suspend the action should be issued.

In a victory for common sense and fairness FWA rejected AH’s main argument that industrial action would delay the operating commencement date of new equipment in the Olivia Newton John Centre.

The Union’s arguments were well supported by authoritative evidence from Medical Physicists, with a special mention for Nikki Shelton.

Importantly, FWA’s decision reinforces our right to take industrial action, including strike action. Even though issues of patient welfare are a significant factor in public health they do not automatically mean that industrial action cannot be taken.

FWA accepted our evidence that Medical Physicists at AH had put patient welfare first and the proper consideration was always given to ensuring it was not compromised.

As a result of the decision, the Union has given the 72 hours’ notice required under the Fair Work Act to AH that industrial action at AH will resume on Friday 7 September 2012.

 
CLARIFICATION OF STATE WIDE INDUSTRIAL PUBLIC SECTOR INDUSTRIAL ACTION

As was reported last STAT report, as a result of FWA proceedings last week the Union has agreed to suspend stop work and strike action for 14 days from last Thursday.

There has been a little confusion about the status of other industrial action as a result of this decision. Please note that all industrial action other than stop work and strike action is continuing and is not impacted by last week’s decision.
