It is almost 2 years since the EBA Renegotiation Committee was elected for the purposes of renegotiating the Dorevitch and GPS EBAs. The interminable delays arose because the Company would not negotiate with us while it was undergoing a corporate take over.

Finally we reached agreement with Symbion in June 2008 over a process for negotiations which aimed to have a new agreement finalised by December 2008. This was scuttled when Primary Health stepped in and stopped negotiations.

Facing no other choice, we made application to the Commission for a ballot to be conducted of MSAV members to take protected industrial action at Dorevitch and Gippsland Pathology.

The Company then pulled out the Workchoices book of dirty tricks. Their solicitors have been brought in to find any and every anti-union provision which can be used to frustrate the wishes of our members for a new enterprise agreement.

This will create further delays but will not change the outcome. We have been through similar disputes before and have always succeeded in our objectives. Provided that we retain strong membership support, we are confident that we will secure a new enterprise agreement in the coming months.

It is disappointing that the new owners of the Company have brought with them such ingrained and unfounded hostility to the very staff who make their profits for them. We understand that Primary Health has little direct experience of negotiating with unions and is therefore on a steep learning curve. The first lesson which it will learn is that their injustice to us will only make us more determined to fight for our rights.
