PUBLIC HOLIDAY ENTITLEMENTS PAYABLE FOR ANZAC DAY 2009 |

We have already had numerous queries from members re Anzac Day. The Victorian Government has not declared a substitute public this year for Anzac Day which falls on Saturday 25 April 2009.
Despite there being no substitute day declared, most members of MSAV, VPA and the AHP are entitled to public holiday payments for Anzac Day whether they work on the day or not.
A similar situation arose in 1999 and 2004 and the same advice applied, and was honoured by employers. Entitlements are as follows:
- All staff rostered for duty on a public holiday are entitled be paid for the time worked with a minimum of four hours wages at the rate of time and a half in addition to their normal weekly wage. (Time off in lieu at the penalty rate with a minimum of six hours time off may be taken by agreement). If an employee is entitled to a full working day off, this may be added to annual leave by mutual consent
- Full-Time Public Sector Rostered Off
Under our public sector award, if a public holiday falls on your rostered day off, you are entitled to one and a half day’s pay in addition to your normal weekly wage. (Or one and a half days off at a time convenient to your employer). This payment applies regardless of the days on the week on which you are normally rostered. Therefore Monday to Friday workers have an entitlement to this payment.
- Full-Time Private Sector Rostered Off
Under our private sector awards, if a public holiday falls on your rostered day off, you have the same entitlement as full timers in the public sector as outlined above.
- Part-Time Public Sector Rostered Off
In the public sector part time members are entitled to a pro-rata payment for the day based upon their average hours of work at the rate of ordinary time.
- Part-Time Private Sector Rostered Off
Some of our private sector agreements also confer an entitlement to a pro-rata payment based upon your average hours of work at the rate of time and a half.
Other private sector agreements provide that if you worked more than 50% of the days on which the public holiday falls, but are rostered off, you are entitled to be paid as per full time employees (pro rata).
If you are employed part-time in the private sector check your current enterprise agreement on the website at www.msav.org.au (login first).
- Part timers with loading are excluded from the benefits of the public holiday clauses of the awards in both public and private sectors. Part-timers with loading are entitled to a 75% loading for working on the day. This is the same as the usual rate for Saturdays.
