A large number of part time members, employed both in the public sector and the private sector have sought the Union’s assistance in dealing with unilateral decisions by their employers to vary their part-time hours, including starting and finishing times, and days of the week, and in some cases hours per week.
The provisions in relation to part time employment in both the Public Sector and Private Sector Awards clearly states that any variation to a part timers set days and hours has to be by mutual agreement between the employer and employee. Any employer who seeks to unilaterally vary a part time employee’s hours and/or pattern of work without agreement is in breach of the Award. If your employer attempts to unilaterally alter your part time hours and you do not agree please contact the MSAV for advice and assistance.
