Confusion has reigned across the public sector regarding the TWO Boxing Day holidays after the Victorian government legislated for both Saturday 26 December 2009 and 28 December 2009 as public holidays.
We have been in touch with the Victorian Hospitals Industrial Association (VHIA) about errors in the Bulletin which they sent out to health services on 24 December 2009 in relation to entitlements to public holiday payments. We understand that the VHIA will be sending out a further Bulletin to health services tomorrow in which the correct instructions will be given to health services in relation to our classifications. This will accord with the information provided to our members in Stat 732, and is consistent with discussions we had with the VHIA prior to Christmas about their advice to health services. We urge members to take up the issue with your own pay office and HR Department in the first instance if you have not been paid correctly. If that is not successful, please contact us. We have some sympathy with payroll staff who have had to deal with a range of different entitlements across a number of awards and agreements that apply to different categories of workers, and with a range of conflicting pieces of advice. Members should seek written confirmation from payroll that they will receive additional payments where these have not been made. This is likely to be the case in relation to the payment for the Boxing Day holiday which fell on 26 December 2009 for Monday to Friday workers, and payment of penalty rates for both the Boxing Day holidays - 26 and the 28 December 2009 - for shift workers rostered on both days.
